Terms and Conditions of Use
Please read these Terms and Conditions carefully before using Acoustic Canvas Studios' services. By accessing or using our studios and services, you agree to be bound by these terms.
1. Usage Agreement
This Usage Agreement ("Agreement") is a legally binding contract between Acoustic Canvas Studios, located at 123 Arts District Avenue, Los Angeles, CA 90013, and you ("Client"). By using our studio facilities and services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions outlined below.
Acoustic Canvas Studios provides recording studio facilities, audio engineering services, and related resources for musicians, producers, and other audio professionals. The Client agrees to use these facilities and services in a responsible and professional manner, adhering to all studio rules and regulations as outlined by Acoustic Canvas Studios staff. Any misuse or abuse of studio equipment or facilities will result in immediate termination of the session and may incur additional charges for damages.
The Client is responsible for ensuring that all materials brought into the studio, including but not limited to audio files, instruments, and personal belongings, are properly secured and insured. Acoustic Canvas Studios is not liable for any loss or damage to the Client's personal property. The Client also warrants that all content recorded or produced in our studios does not infringe upon any copyright, trademark, or other intellectual property rights. The Client agrees to indemnify and hold harmless Acoustic Canvas Studios from any claims or liabilities arising from such infringements.
Acoustic Canvas Studios reserves the right to refuse service to any Client who violates these terms or engages in any behavior deemed inappropriate or disruptive. We are committed to providing a safe and professional environment for all our clients and staff, and we expect all users of our facilities to conduct themselves accordingly.
2. Payment Terms
All studio sessions and services provided by Acoustic Canvas Studios are subject to payment in accordance with our published rates. A deposit, typically 50% of the total estimated cost, is required to secure your booking. This deposit is non-refundable unless the cancellation policy outlined below is followed.
The remaining balance is due upon completion of the studio session or service. We accept various forms of payment, including cash, credit card (Visa, Mastercard, American Express), and electronic transfers. Checks are generally not accepted unless prior arrangements have been made with studio management.
Overtime charges may apply if the session exceeds the initially scheduled time. These charges will be calculated based on the hourly rate for the specific studio or service being used. The Client will be notified of any potential overtime charges before they are incurred.
Acoustic Canvas Studios reserves the right to adjust pricing for services and studio rental without prior notice. However, once a booking is confirmed with a deposit, the agreed-upon rate will be honored. All prices are listed in U.S. Dollars (USD) and are exclusive of any applicable taxes. The Client is responsible for paying any taxes associated with the use of our services.
Late payments may be subject to interest charges at a rate of 1.5% per month, or the maximum rate permitted by law, whichever is lower. Acoustic Canvas Studios reserves the right to pursue legal action to recover any outstanding balances. We encourage Clients to communicate any payment concerns or issues promptly to avoid potential complications.
3. Cancellation Policy
Cancellations of scheduled studio sessions must be made at least 72 hours prior to the scheduled start time to receive a full refund of the deposit. Cancellations made within 72 hours but more than 24 hours of the scheduled start time will result in a 50% refund of the deposit. Cancellations made within 24 hours of the scheduled start time will result in forfeiture of the entire deposit.
Rescheduling of studio sessions is subject to availability and must be requested at least 48 hours prior to the scheduled start time. Rescheduling requests made within 48 hours may be subject to a rescheduling fee. Acoustic Canvas Studios will make every effort to accommodate rescheduling requests, but cannot guarantee availability.
In the event that Acoustic Canvas Studios is forced to cancel a scheduled session due to unforeseen circumstances (e.g., equipment malfunction, power outage), the Client will receive a full refund of the deposit or the option to reschedule the session at no additional cost. Acoustic Canvas Studios is not liable for any consequential damages resulting from such cancellations.
No-shows will be treated as cancellations made within 24 hours, and the entire deposit will be forfeited. We understand that emergencies can arise, and we encourage Clients to communicate any potential issues as soon as possible to explore potential solutions.
4. Liability Disclaimer
Acoustic Canvas Studios provides its facilities and services on an "as is" basis, and we make no warranties, express or implied, regarding the suitability, reliability, or availability of our services. To the fullest extent permitted by law, Acoustic Canvas Studios disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use of our studios and services.
This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, or any other pecuniary loss, even if Acoustic Canvas Studios has been advised of the possibility of such damages. The Client assumes all responsibility and risk for the use of our facilities and services.
Acoustic Canvas Studios is not responsible for any injury to persons or damage to property occurring on our premises, except to the extent caused by our gross negligence or willful misconduct. The Client agrees to indemnify and hold harmless Acoustic Canvas Studios, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from the Client's use of our facilities or services.
The Client is responsible for maintaining adequate insurance coverage to protect against any potential losses or liabilities. This includes, but is not limited to, insurance for personal property, liability insurance, and workers' compensation insurance (if applicable). By using our services, the Client acknowledges and agrees to this liability disclaimer. These terms and conditions are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in Los Angeles County, California.
